Terms of Use
1. The short version
- These Terms are the agreement between you and Yaniv Cohen, an exempt dealer (עוסק פטור) in Israel who runs OrQuest (section 2).
- Apart from a short sample lesson during setup, the OrQuest app needs a subscription; the website is free to read. Eligible new subscribers get 7 days free, and the trial becomes a paid subscription unless you cancel by the last day the app shows (section 8).
- Each plan, yearly or monthly, is an ongoing subscription with no fixed end, charged in advance by Apple or Google until you cancel. The price is the store's total, shown before you confirm; we add nothing to it.
- Before a free trial ends, about 30 days before each yearly renewal, and once a year on the monthly plan, OrQuest reminds you on your device (section 8.8 says how, and when a reminder may not come).
- Cancel at any time, free, in your store (at least 24 hours before a renewal, to stop it) or by telling us. On Google Play we cancel for you within 3 business days of receiving your notice (by registered mail, within 6 business days of the day it was posted); on the App Store only Apple can stop the billing, so within 1 business day we send you Apple's steps to finish there (section 9).
- Refunds: on Google Play we refund your first paid charge for OrQuest on your store account, or a yearly renewal charge, in full if you ask within 14 days of it; Apple decides App Store refunds, and if the law entitles you to a refund from us and Apple does not give it, we pay it ourselves (section 10). These limits do not apply where the law gives you a right to cancel or to a refund, and they do not reduce that right.
- Consumers in Israel can end a subscription early and get back the unused part, by a notice to us or, where the store offers it, at once through the store, and can cancel a new one within 14 days of its first paid charge, or of receiving the Purchase summary if later (section 24).
- Only adults buy, sign in, join the live league or add friends. A child profile's own screens never show a price, plan or offer, or a countdown to a purchase, and the subscription screen opens from one only after the parent question (section 5).
- OrQuest teaches: it does not rule on Jewish law or give safety advice (section 15).
- Profiles, including every child profile, and any progress not saved to an adult's account stay only on your device. We do not back them up, so if the device is lost or reset they are gone (section 6.3).
- We answer for our own faults, with no money limit for consumers, and your consumer rights come first (sections 16 and 18).
- Israeli law applies, you keep the protection of the law where you live, and you can always go to court (section 22).

2. Who we are
OrQuest (אור־קווסט) is made and run by one person, who is responsible to you for it:
- Name: Yaniv Cohen (יניב כהן), trading as OrQuest
- Status: exempt dealer (עוסק פטור) registered with the Israel Tax Authority
- ID number, which is also the dealer number: 215953259
- Address in Israel, including for registered mail: 12 HaShoftim St, Tel Aviv, Israel
- Phone: +972 52 386 4584 (Sat, 1:00-1:00)
- Email: support@orquestapp.com
"We", "us" and "our" mean Yaniv Cohen, trading as OrQuest. The app shows these details in About, in Settings under Legal and help, and under Seller details on the subscription screen, and so does Contact and business details.
Notices. When these Terms promise to tell you something, we publish a dated notice at Past versions and show it in the app, in an app update if needed, at least as many days ahead as promised; we may also email account holders. For a price change, your store also tells you under its own rules. Your notices to us may use any channel in section 27, in any form, and count from when they reach us; a cancellation notice sent by registered mail counts as sections 9.3 and 24.4 say.
3. Words used in these Terms
- OrQuest: the app for iPhone, iPad and Android, its content, the website orquestapp.com, and the services behind them.
- Consumer: someone who uses OrQuest mainly for personal, family or household purposes, and anyone else whom the law where they live treats as a consumer for this purchase, such as a business or school under the Australian Consumer Law or New Zealand's Consumer Guarantees Act. Anyone else is a business user.
- Adult: a person aged 18 or over, the age the app's age question uses. Where the law where you live sets a higher age for making this contract, you keep the protection that law gives, and sections 5.6 and 10.3 apply to anyone below that age.
- Store: the App Store or Google Play; your store account is your Apple Account or Google Account.
- Profile: a learner's space on the device, marked as an adult profile or a child profile. Account: an optional sign-in for an adult (section 14). Live league and practice league: section 6.2. The parent question: section 5.5.
- Business day: Sunday to Thursday, except Israel's official days of rest, such as the festivals and Independence Day. Where a law that protects you counts days in a way that is better for you, we count them that way.
- Unused part: what you paid for a billing period, divided by its number of days, times the whole days left in it after the subscription ends. When a store refunds, it calculates the refund its own way.
4. How these Terms work
- What they cover. These Terms are the contract between you and us for OrQuest. For a copy from the App Store, they are also its licence agreement (EULA), with section 25. The Apple Media Services Terms and Conditions or the Google Play Terms of Service cover your store account and payment, between you and the store.
- How you accept. You accept these Terms by continuing past the welcome screen, whose line says that continuing is agreeing to them and links to them. Setting up OrQuest, with its sample lesson, costs nothing. You accept them again when you start a free trial or a subscription (the line directly above the button says so, and that you agree to the automatic renewal described above it) and when you sign in to or create an account (the sign-in screen says so). They also apply when you use the website. A child who continues is not a party to them (section 5.2). If you do not accept them, do not continue past the welcome screen.
- A record. When you start a trial or a subscription on OrQuest's subscription screen, or sign in, OrQuest records which version of these Terms you accepted and which version of the Privacy Policy you were shown, when, on which screen, in which language and in which version of the app: on your device; with RevenueCat, our subscription service, for a trial or a subscription; and, for a record made while you are signed in, with your account. Continuing past the welcome screen is not recorded.
- Separate notices. The Privacy Policy and Cookies and device storage are notices, not part of this contract, and we do not ask you to agree to them. Where we need your consent, we ask for it separately.
- Languages and copies. The Hebrew and English versions are both official; if they differ, the one more favourable to you applies. These Terms are always at Terms of Use and in Settings, and earlier versions at Past versions.
5. Who can use OrQuest, and who can buy
5.1 Adults
Only an adult may start a free trial, buy or restore a subscription, create or use an account, join the live league or add friends, and only for their own or their family's learning.
5.2 Children
Anyone under 18 may use OrQuest only on a child profile that a parent or guardian has set up, or allowed, on their device. A child is not a party to these Terms, and nothing here takes away a child's rights. The adult who sets up a child profile, or lets a child use OrQuest, is responsible for supervising that use. A child profile stays on the device and never signs in or syncs.
5.3 OrQuest does not sell to children
A child profile's own screens never show a price, plan, free trial or offer, or a countdown to a purchase, and we never use a child's name or picture to sell. Without a subscription, a child profile shows a calm screen whose only way on is a "For grown-ups" button behind the parent question. Only after that question does the subscription screen for an adult open, with its prices and plans, but never with the one-time offer, a countdown or the child's name.
5.4 The age question
The app asks for a year and a month of birth, with no answer chosen in advance, before a profile becomes an adult's: during setup, when you answer "I am" to "Who is learning?", and in Family, when an adult profile is added or a profile is changed into an adult's. Anyone under 18 is treated as a child: the profile becomes a child profile, with no sign-in, no account, no live league and no friends. Only an age group is kept, on the device, and it is sent nowhere. An adult profile that has no answer yet is asked before Family saves it again as an adult's and before any way to sign in, and is never shown the one-time offer. If a year was entered by mistake, an adult can change the profile to an adult's in Family, after the parent question, and give the year and month again there.
If we learn that an account belongs to someone under 18, for example because a wrong year was given, we close the account and delete what it holds, as the Privacy Policy explains. This is not a penalty: the profiles and progress on the device stay, closing the account does not cancel a store subscription, and a parent can cancel it (section 9) and ask for a refund (section 10.3).
5.5 The parent question
On a device with a child profile, OrQuest asks a short arithmetic question, written out in words, before:
- buying, restoring or managing a subscription;
- opening the subscription screen or the Purchase summary from a child profile;
- the page a free-trial reminder opens;
- signing in;
- leaving the app, such as opening a web page (including the legal pages and the siddur's source links), an email or a phone call;
- sharing;
- the parent area of Settings;
- turning on the daily reminder in Settings;
- Delete everything, Reset lesson progress and removing a profile;
- switching from a child profile to an adult one;
- in Family, changing a child profile into an adult one, or adding an adult profile while a child profile is open.
During setup, on any device, it also comes before a year of birth already given is changed.
A correct answer lasts up to 5 minutes, and ends sooner when you leave that screen, leave the app or switch profile. Some screens keep it during a trip out of the app that they opened themselves, such as to your store, a web page or your email for a sign-in code.
It is a speed bump against accidents, not a lock and not a parent's consent: an older child may solve it. For real control, use your device's screen lock and your store's family tools, such as Ask to Buy (Apple) or Family Link (Google).
5.6 Laws that require a parent's consent
Where a law, such as one in Texas, requires a parent's consent before a minor accepts an app's terms or buys in it, we will not enforce these Terms against a minor who accepted them without that consent. Section 10.3 covers a purchase a minor made without consent.
5.7 Where OrQuest is offered
OrQuest is offered on the App Store and Google Play in Israel, Switzerland, Australia and New Zealand. If you use it from elsewhere, you keep any rights your local law gives you.
6. What OrQuest is
6.1 The service
OrQuest is an app for learning Hebrew and Torah, alone or as a family, along three paths: Hebrew, Shabbat and Torah. A subscription or free trial opens all of it:
- Hebrew: the alphabet, vowels and reading; the Hebrew of prayer and Torah, root by root; and everyday modern Hebrew.
- Torah: 30 selected passages from Bereshit to Devarim (not the whole Torah), each verse explained for children (about 7 to 11), teenagers and adults; and short illustrated stories from some of the weekly parashot (we may add more in updates).
- Siddur: prayers in the Ashkenaz, Sefard and Edot HaMizrach nusachim, from named editions, with explanations.
- More: the Jewish year, place guides, a phrasebook, review, the Torah passages' verses read aloud by an AI voice, and game features (XP, streaks, gems, hearts, a gem-only shop, achievements, gifts, leagues and friends).
OrQuest shows no advertising, and OrQuest itself generates nothing with AI while you use it: Ner, the lamp who guides you, says only lines we wrote, and speech other than the Torah passages' verses comes from your device's own voice (section 15). Section 12 governs changes.
6.2 Profiles, leagues, friends and sharing
- Profiles. A subscription allows up to 6 profiles on a device. Anyone holding the device can open the Family screen, showing every profile's name, picture, level, streak and current unit, and this week's days, minutes, lessons and XP.
- The practice league shows invented names with simulated points, only on your device, for children, anyone not signed in, and adults who have not joined the live league.
- The live league is for signed-in adults who tap "Join the live board" after the app shows what others will see; it is off until then, and you choose on each device: another device signed in to the same account sends nothing to the live league until you tap there too. A live group has up to 30 people, including you, who see your league name (generated by the app), weekly XP, tier and weekly result, never your name, email or picture. To leave, choose "Use simulated board" on the League screen of the device where you joined, which switches you to the practice league, or sign out on that device; if you joined on more than one device, do this on each of them.
- Friends. Signed-in adults can add up to 50 friends, and anyone holding your friend code can add you. Friends see each other's league name, XP on the live league this week (0 for anyone not on it), whether each is on the live league this week and, while they are, their tier.
- Sharing. A card of what you learned goes to apps you choose. It never shows a profile's name or profile picture. On an adult's own card, the adult may add a photo from the device as the background: choose only a photo you have the right to share, and think carefully before sharing a picture of a child (section 13). A card about a child's learning carries no photo. On Android the caption is also copied to your clipboard. Once you share a card, the apps and people you sent it to control it, and we cannot recall or delete it.
- Daily reminder. Optional, never on Shabbat or festivals as kept in Israel. The lock screen may show your streak and, when the only profile is an adult's, its name. On a device with a child profile it never shows a streak, and turning it on in Settings comes after the parent question.
6.3 What stays on your device, and what reaches us
| What | Where it is kept |
|---|---|
| Every profile's name, picture, goals, path and trip; settings; answers to the opening questions; saved items, the activity log, gems and hearts; names you give friends; the age group; everything in a child profile; the one-time offer's timing, your Purchase summary (plan, price, store and dates), the record of an active subscription, and scheduled reminders; when you chose to join the live league | Only on your device |
| One adult profile's progress (XP, streak, day-by-day history for the last 90 days, lesson and story progress, review schedule, stats, and achievements without their dates) | On your device and, if you sign in, in your account |
| Records of the version of these Terms you accepted and the version of the Privacy Policy you were shown, and of when your Purchase summary was first shown | On your device; with RevenueCat, for a free trial or a subscription you start on OrQuest's subscription screen; and, for an acceptance made while you are signed in, with your account |
| Your email address and how you sign in; your friend code and friends; your live league entries, if you join | On our server, for a signed-in adult |
| Purchases and subscription status | With Apple or Google, and with RevenueCat, which manages subscriptions for us |
Supabase runs our server, and the Privacy Policy lists every recipient and says how long information is kept. While a child profile is in use, the app may still check the family's subscription and update a signed-in adult's account in the background. Nothing the child enters or creates, such as a name, picture or progress, is sent; only the device's technical identifiers are (Privacy Policy, section 22).
We do not back up what is kept only on your device. If the device is lost, reset or replaced, the app is deleted, or you use Delete everything, it is gone. Your own device backups do not bring it back: they do not hold the profiles or progress (on iPhone and iPad, a backup can hold profile pictures). Only the synced adult profile's progress comes back, when you sign in again.
6.4 What needs a connection
Lessons, texts, pictures, the verse audio and the practice league work offline. A connection is needed to check your subscription (through RevenueCat, when the app opens and from time to time), to buy, restore or manage one, to sign in and sync, for the live league and friends, and to open web pages. Making and sharing a card works offline, though the app you send it to may need a connection. Live league XP counts only if it reaches us before that league week ends. If something is hard to use, the Accessibility statement explains how to get help another way.
7. Your licence, our content and open licences
7.1 Your licence
We give you a personal, non-exclusive, non-transferable licence to use OrQuest on devices you own or control, for your own and your family's non-commercial learning, while you keep to these Terms; the paid parts are open while a subscription or free trial is active. We may end this licence only under section 19. Schools and other organisations need our written agreement to use OrQuest with learners, and section 17 applies to business use.
You must not, or help anyone to:
- copy, sell, rent, lend, sublicense or redistribute the app or our content, except as section 7.2 or the law allows;
- copy our lessons, explanations, stories, translations or pictures in bulk, or use them to build a competing product;
- open paid parts without a subscription, or get around the app's purchase, age or parent-question checks;
- use automated tools to extract content from the app, or to create or operate accounts;
- reverse engineer, decompile or disassemble the app, except where the law gives you that right;
- remove or hide copyright, licence or credit notices.
7.2 Open licences come first
The Torah verses come from Miqra according to the Masorah (MAM), under CC BY-SA 4.0. The prayers, Hebcal's calendar data, the fonts and the open-source software are in the public domain or under their own open licences. Credits and licences, also in the app in Settings under Legal and help, lists these sources and the open-source packages the app uses directly, with their licences and what we changed.
Nothing in these Terms limits what those licences, or the public domain, allow you to do with that material, and the restrictions in section 7.1 do not apply to it. The MAM text as we adapted it is offered under CC BY-SA 4.0, and Credits and licences says how to get a copy.
7.3 Our content, names and your feedback
Everything else in OrQuest belongs to us or our licensors: the software and design, and the lessons, explanations, stories, translations, place guides, phrasebook, Ner, sounds and icons made for it. The illustrations, films and reward icons were made with AI tools; we claim rights in them only to the extent the law gives rights in such material. OrQuest and אור־קווסט are the names we trade under, and Ner and our logo were made for OrQuest: do not use them in a way that suggests something comes from us or is approved by us. Naming Apple, Google or any other company does not mean they endorse OrQuest.
If you send us ideas or corrections, we may use them to improve OrQuest and its content, free, worldwide and without time limit. You keep any rights you have in what you wrote, and we never publish your words or your name without your written permission, or a parent's for a child.
If you think something in OrQuest uses your work or your rights, write to support@orquestapp.com or our postal address (section 2), saying what the material is, where it appears and what right you hold. We reply in substance within 10 business days and, where the claim appears well founded, change or remove the material: on the website promptly, and in the app in the next update. This does not limit anyone's right to go to court.
7.4 The website
You may read, print, save, share and link to the pages of orquestapp.com. Republishing or selling our own text, pictures or design from it needs our permission, except as section 7.2 allows. These Terms do not forbid the search, AI-answer and AI-training uses that the site's robots.txt file allows, but those uses do not include republishing. Do not overload the site or interfere with its security. Other sites we link to, such as the siddur's sources, have their own terms, and we do not control them.
8. Subscriptions
8.1 An ongoing subscription, with no fixed end
Apart from a short sample lesson during setup, the OrQuest app needs a subscription or free trial; there is no free version of the app. The pages of orquestapp.com are free to read (section 7.4). Each plan is an ongoing subscription for an indefinite period, charged in advance by Apple or Google for each billing period (a year or a month) until you cancel. It has no end date and no minimum term: the yearly plan is not a commitment for a year, you can cancel at any time (section 9), and consumers in Israel can also end it early and get back the unused part (section 24.4).
Your store takes the payment under its own terms and, depending on the store and country, sells in its own name or acts for us (section 24.2 covers Israel). Either way, we provide OrQuest under these Terms.
8.2 Plans and prices
- Price. The store's total in your currency, including any tax the store collects, shown on the subscription screen and on the store's purchase screen before you confirm. We add no VAT or other charge.
- Choosing. The screen opens with the yearly plan selected; one tap chooses monthly. The amount charged for a plan is always the largest and most prominent of the prices shown for it; a crossed-out price, or a per-month figure shown for a yearly plan, is never the amount charged. The saving shown on the yearly plan compares its price with 12 times the monthly plan's current price, rounded down.
- Timing. The store may charge up to 24 hours before each new period.
- Only through the store. We sell only through your store: on its purchase screen in the app or, to take up a subscription again, in the store's own subscription settings. We never sell by phone, chat, email or in person.
- No Family Sharing. Subscriptions are not shared through Apple's Family Sharing or Google Play's family library.
8.3 The free trial
- Who. Eligible new subscribers get 7 days free. The store decides eligibility; in general, a store account gets one free trial of OrQuest, whatever the plan.
- Before you start, the subscription screen shows the plan, the price after the trial, the first charge date and the last day to cancel free, which falls at least 24 hours before the trial ends. To be sure you pay nothing, cancel in your store by the end of that day: a notice to us can take up to 3 business days from when it reaches us to act on, and on the App Store only Apple can stop the charge, so a notice to us close to that day may not prevent the first charge (section 10 covers refunds). If the trial is still set to renew when it ends, the store charges that price on the date shown, or up to 24 hours earlier.
- Holds. Google Play may place a temporary authorisation hold on your payment method. A hold is not a charge.
- Cancelling during the trial costs nothing, and where the store allows it, you keep access until the trial's scheduled end.
8.4 The one-time offer
The first time the close button (X) on the subscription screen is pressed on a device, OrQuest shows the one-time offer, if its plans are available in your store. It is never shown on a child profile, or on an adult profile that has not yet answered the age question (section 5.4).
| Question | Answer |
|---|---|
| What is it? | Separate lower-priced plans, each for the same billing period as a standard plan, opening exactly what the standard plans open, with the same free trial (section 8.3) for eligible new subscribers. There is no limit on how many people can take it. |
| How long? | 48 hours from when it is first shown on that device. An end on Shabbat or Yom Tov (as kept in Israel; Chol HaMoed does not count), or after 12:00 the day before one, moves to 12:00 on the next day that is not Shabbat or Yom Tov. The end is set once, at the first press, in the device's time zone, and is only ever extended. On Android the screen shows a clock, and says so when the end has moved. On iPhone and iPad it does so only when OrQuest can tell that your Apple Account has never had an OrQuest subscription (the App Store says it can still take the free trial, and RevenueCat has no record of an earlier App Store purchase); otherwise it shows no clock, and where OrQuest can tell that your Apple Account has or had one, it says instead "These plans may also be in your App Store subscription settings." |
| Crossed-out price | The standard plan's current price for the same period, store and currency. The percentage saved is measured against it and rounded down. |
| Later price | It renews at its lower price while the subscription continues without a break, and section 11 applies as to every plan. After a break, the lower price may be gone. |
| While it lasts, and after | Pressing X again, restarting the app or Delete everything does not restart its 48 hours. While it lasts, each press of X on the subscription screen at the end of setup, or on the one shown because there is no subscription, opens it again; when you open the subscription screen from anywhere else in the app, it opens once per visit. Once it ends, OrQuest's subscription screen no longer offers its plans on that device. Your store's own subscription settings may still offer them, at the price shown there: on the App Store they are in the same subscription group as the standard plans, so Apple's subscription settings, which Manage subscription in Settings can lead to, may list them for anyone whose Apple Account has or had an OrQuest subscription, which is why the screen shows such an account no clock. We do not promise any discount again. |
| Which device | Its timing is kept only on the device, so a reinstall or another device may show it again with its own 48 hours. |
8.5 What a subscription includes
All of OrQuest (section 6.1), for up to 6 profiles on each device where it is active, with hearts that never run out. Without a subscription a device holds one profile, but a family whose subscription ended keeps its profiles.
Nothing else is for sale. Gems, hearts, XP, streaks, achievements, gifts, tiers and ranks have no money value and cannot be bought with money, sold, transferred or cashed out. The shop takes gems only, and a gift is a fixed card of lesson content, never a lucky draw. We may change how these features work, for the reasons in section 12; if a change reduces what your paid subscription gives you in more than a minor way, section 12's notice, free cancellation and refund apply.
8.6 Devices, accounts and Restore purchases
- Not signed in: access follows the store account that bought the subscription. On another device with that store account, tap Restore purchases on the subscription screen or in Settings.
- Signed in: access follows your OrQuest account on any iPhone, iPad or Android device where you sign in to it. You still manage and cancel in the store that sold it.
- Signing out or deleting your account takes the subscription off that device until you sign in or restore again. Neither cancels it.
8.7 When a subscription ends
Access continues to the end of the paid period, unless it ends sooner under section 9 or 24. Then the app opens on the subscription screen (on a child profile, the calm screen in section 5.3); Settings, Family, About, the legal pages, sign-in and Restore purchases stay open, within the limits of sections 5.4 and 5.5, and profiles and progress are kept, so you can carry on if you subscribe again. Signing in needs an adult's profile: from a child profile, For grown-ups leads, after the parent question, to the subscription screen, whose Profiles link opens Family to switch to one. A device whose only profiles are children's has no adult's profile to switch to and cannot add one without a subscription (section 8.5); on it you can buy or restore a subscription through For grown-ups. If the app cannot reach the store, it may stay open for up to 3 days after the paid period, at no charge.
8.8 Reminders
- Before a free trial ends: one notification at 10:00, on or before the last day to cancel free (about 2 days before the end), on each device where the trial started or was restored, or where you signed in to your account during it, if notifications are on and the trial is set to renew. It skips Shabbat and the festivals as kept in Israel, including Chol HaMoed and the day before each festival, so it may come earlier, or not at all if no day fits. On a device with a child profile, it names no price. Tapping it opens a page that shows where the trial stands, with Manage subscription and, while there is still something to stop, Other ways to cancel (on a device with a child profile, after the parent question).
- Before each yearly renewal: about 30 days before, our renewal notice for the yearly plan, in three places.
- A notification, where notifications are allowed. It names the last day to cancel to avoid that charge. It skips the same days as the trial reminder, so it may come earlier, or not at all if no day fits. It ends with our email address, and on a device with a child profile it names no price. Tapping it opens Settings, where the subscription shows the price, when the app knows it, and the ways to cancel (on a device with a child profile, after the parent question). The app sets it from the renewal date it last saw, and also sets one a year ahead, for the renewal after that (during a free trial of the yearly plan, for the first renewal), so a notification still comes if OrQuest is not opened on that device for up to a year; if it is not opened there for longer, a later notification may not come. The one set ahead names the price, as it was when it was set, only on a device without a child profile; it says it applies only if the plan is still set to renew, and may come even after you cancel in your store, if OrQuest was not opened on that device since. A device where the subscription was restored less than 30 days before the renewal gets none for that renewal.
- A banner on the Learn screen of an adult profile, even if notifications are off, with Manage subscription and Other ways to cancel, until you close it for that renewal; closing it leaves the notice in Settings. It shows only while this device can confirm the subscription: not before its first check after Delete everything, and not after you sign out or delete your account on it. Child profiles never show it.
- Settings, under Subscription (on a device with a child profile: For parents, then Account and subscription, after the parent question), shows the notice on the same days and conditions as the banner, with Manage subscription and Other ways to cancel, so a device with only child profiles shows it there.
- Once a year on the monthly plan: on each anniversary of the day the subscription began (the first day of its free trial, if it began with one), our reminder that the monthly plan renews every month until you cancel, with its price when the app knows it and how to cancel, in the same three places.
- A notification at 10:00, where notifications are allowed. If the anniversary is one of the days the trial reminder skips, it comes on the last day before it that is not, or not at all if no day fits. It ends with our email address, and on a device with a child profile it names no price and has no buttons. Tapping it opens Settings, where the subscription shows the price, when the app knows it, and the ways to cancel (on a device with a child profile, after the parent question). The app sets the next one when the plan starts and whenever OrQuest is opened, so a notification still comes if OrQuest is not opened on that device for up to a year; if it is not opened there for longer, a later notification may not come. It names the price, as it was when it was set, only on a device without a child profile; it says it applies only if the plan is still set to renew, and may come even after you cancel in your store, if OrQuest was not opened on that device since.
- The banner and Settings: the Learn screen of an adult profile and Settings, under Subscription (on a device with a child profile, after the parent question), show it for 14 days from the anniversary (from the notification's day, if that is earlier), with Manage subscription and Other ways to cancel, on the same conditions as the yearly notice, so a device with only child profiles shows it in Settings.
A reminder never changes a date or a price.
8.9 Your Purchase summary
Once a free trial starts or a purchase completes on OrQuest's subscription screen, your Purchase summary (סיכום העסקה) is ready in Settings under Legal and help: our details; plan, price, store and billing period; trial dates, first charge and the last day to cancel free; every way to cancel and your refund rights; and the versions of these Terms and the Privacy Policy. It does not open by itself. You receive it the first time you open it, and we keep that time with the purchase; on a child profile it opens after the parent question. It is in the app's language and can be shared to keep a copy. The device keeps the summary of its latest purchase only, so a later purchase on it replaces the earlier one. Without the device's record of the purchase (a subscription bought or restored elsewhere, a purchase approved or completed after the subscription screen closed, such as one waiting for approval, or after Delete everything or a reinstall), the summary appears there only while the subscription is in force, and points to your store account for the price. Share a copy to keep one.
9. Cancelling a subscription
Anyone can cancel at any time, free, without giving a reason or signing in. Cancel a subscription has the same steps and a notice you can copy or send from the page.
9.1 In the store (the fastest way)
- iPhone or iPad: the device's Settings app (not OrQuest's), your name, Subscriptions, OrQuest, Cancel Subscription; or your Apple subscriptions page. No Cancel button means it is already cancelled.
- Android: your Google Play subscriptions, OrQuest, Cancel subscription.
- Inside OrQuest: Manage subscription in Settings opens a subscription screen from RevenueCat, our subscription service, from which you can cancel in your store, or, if that screen cannot open, your store's own page; on a device with a child profile it is under For parents, then Account and subscription, after the parent question. That screen asks no reason and offers no discount before you cancel. It appears once this device knows about your subscription; if you do not see it, use the store steps above.
To stop the next renewal, cancel at least 24 hours before the current period ends; access continues to the end of the paid period. To avoid a trial's first charge, cancel by the last day shown in the app. Consumers in Israel can also end a subscription early and get back the unused part (section 24.4).
9.2 Or tell us
| Channel | Where |
|---|---|
| Phone | +972 52 386 4584 (Sat, 1:00-1:00) |
| support@orquestapp.com | |
| Registered mail | Yaniv Cohen (OrQuest), 12 HaShoftim St, Tel Aviv, Israel |
| Online | Cancel a subscription, linked from the orquestapp.com home page |
A notice needs only your full name and, for a notice under Israel's Consumer Protection Law, 5741-1981, your ID number. The store, the order number and any later end date you want help us, but are not required. If something is missing, we still start and ask. Never send a password or card details. Calls are answered in the hours shown; email and the online page reach us at any time.
9.3 What we do, and how fast
| When | What we do |
|---|---|
| Within 1 business day | We confirm your notice arrived. For the App Store, the reply gives Apple's steps and, if your Apple Account is in Israel, Apple's route to cancel at once with a pro-rata refund. |
| Within 3 business days of receiving it, or, for a notice sent by registered mail, within 6 business days of the day it was posted | Google Play: we cancel the subscription ourselves. App Store: Apple does not let developers cancel, so you finish with Apple; section 24.6 covers a later Apple charge to a consumer in Israel. |
| When it is done | We confirm the end date and any refund in writing, by email or, if you have none, by post. |
On Google Play, for a consumer in Israel the subscription ends within that time, or on the later date named, with a refund of the unused part, unless you prefer us just to stop the renewal. For everyone else it stops renewing, and section 10 covers refunds. If your notice does not let us find your subscription, it still takes effect on time: we ask you for a detail that helps us find it, and on Google Play we refund any charge made after it took effect.
9.4 What does not cancel, and no fees
Deleting the app, Delete everything, signing out and Delete account do not cancel a subscription; the store keeps renewing it. There is no cancellation fee, and nothing is owed for any period after a subscription ends.
10. Refunds
10.1 App Store
Apple takes App Store payments and decides App Store refunds; our agreement with Apple does not let us refund them through the App Store. Ask Apple at reportaproblem.apple.com.
- If your Apple Account is in Israel: Apple's terms for Israel give you the right to cancel a subscription at any time with immediate effect and receive a pro-rata refund, through Apple Support or by phone on 03-3762915 (local rates).
- If the law entitles you to a refund from us and Apple does not give it, we pay it ourselves (section 10.4).
The limits on App Store refunds in this section do not apply where the law gives you a right to cancel or to a refund, and they do not reduce that right.
10.2 Google Play
On Google Play we handle refunds ourselves:
| What you ask about | What we refund | When to ask |
|---|---|---|
| Your first paid charge for OrQuest on your store account | All of it | Within 14 days of the charge |
| A yearly renewal charge | All of it | Within 14 days of the charge |
| Any charge, for a consumer in Israel | The unused part of the period | At any time |
| Anything else | We consider every request fairly, and always refund where the law requires | At any time |
No fees; if more than one row fits, you get the larger refund. Ask through any channel in section 9.2. The order number (it starts with GPA) or your store account's email helps us find the charge but is not required, and a consumer in Israel who cancels by a notice to us gets the unused part back without a separate request (section 9.3). We refund through Google Play, and a full refund ends the period that charge paid for. Google also has its own route: Google Play refund policies.
These limits do not apply where the law gives you a right to cancel or to a refund, and they do not reduce that right.
10.3 A purchase a child made without permission
Only adults may buy. If a child bought or started a subscription without your permission, tell us within 30 days of finding out. On Google Play, we cancel and refund it in full. On the App Store, we help you ask Apple to cancel and refund it, and if the law entitles you to a refund and Apple does not give it, we pay it ourselves (section 10.4). This does not shorten any longer period, or limit any other right, the law gives you, including a parent's right to cancel a minor's transaction under the Legal Capacity and Guardianship Law, 5722-1962.
10.4 How refunds in these Terms are paid
Unless a section says otherwise, a refund these Terms promise comes from us on Google Play, and on the App Store from Apple, or from us if the law entitles you to it and Apple does not give it. We pay our own App Store refunds within 14 days of receiving your request, by a method we agree with you. Each charge is paid back only once: if a store or your card issuer later pays back a charge we have already paid back ourselves, we may ask you to return our payment.
10.5 Rights to withdraw
If your local law gives consumers a right to withdraw from a new online contract, you have it: use your store's process or tell us, and we will help. Consumers in Israel have the 14-day right in section 24.5.
11. Price changes
- Why. Only because of inflation, a change in taxes or the law, or a rise outside our control in one of these costs of providing OrQuest: store fees, our service providers' list prices, or exchange rates.
- When. Only for future periods: from your first renewal at least 30 days after our notice (section 2), never for a period already paid for. Where your law sets a window for this notice (California and New York do), we also give one within it, in the app.
- The store asks too. Apple or Google also tells you and, where its rules or the law require, asks you to accept. If you do not, the subscription ends with the paid period, without the new price.
- If the store does not ask. If a store charges a higher price without asking you to accept it, you may cancel within 14 days of that first higher charge and get back the unused part of the period it paid for (section 10.4).
- Your choice. If you do not want the new price, cancel before that renewal, free (section 9).
- Every plan. This covers the one-time offer's plans too. A store may itself change a price after a tax change, telling you under its own terms.
12. Changes to OrQuest
We may add lessons, stories and features, and adding them never changes your price by itself. We change or remove content or features only for one or more of these reasons:
- to fix errors or make content more accurate;
- to improve learning or how the app works;
- to keep OrQuest secure, or working with new devices and versions of iOS and Android;
- to follow the law, a court's or regulator's decision, or store rules;
- because content, a licence or a service we rely on is no longer available to us on reasonable terms;
- to retire a little-used feature, so that OrQuest stays sustainable.
If a change reduces what your paid subscription gives you in more than a minor way, we tell you at least 30 days before (or as soon as we can, if a law, court, regulator, store or content owner gives us less time); you may cancel free within 30 days of our notice or of the change, whichever is later, and if you do, you get back the part of any paid period after the change (section 10.4). Where your law sets a window for this notice (New York does), we also give one within it, in the app. We will not reduce the core of a subscription (the lessons, Torah passages, siddur, calendar, place guides and review) during a period you have paid for without giving you that choice.
13. Fair play: the live league, friends and sharing
The live league and friends are for signed-in adults, under generated names, with no chat or free text. Use OrQuest lawfully and in good faith, and do not:
- use it to break the law or harm anyone, or pretend to be someone else;
- try to reach our systems, other learners' information or closed parts, or interfere with OrQuest, or get around its security, purchase, age or parent-question checks;
- let a child use an adult profile, or pass the parent question for a child, so that the child reaches an account, the live league or friends;
- earn XP other than by learning (such as with modified apps, automated tools or extra accounts), or trade accounts;
- guess, collect or publish others' friend codes, or use a code to follow or harass anyone;
- share photos you have no right to share. Think carefully before sharing a picture of a child.
Reporting misuse. To report cheating or a misused friend code, write to support@orquestapp.com with the league name. We look into every report and act under this section.
What we may do. If someone breaks section 7.1 or this section, we act in proportion, and only by one or more of these steps: removing an entry from a live group or resetting that week's XP; pausing access to the live league or friends; suspending or closing an account, only for serious, repeated or unlawful misuse; or ending the licence under section 19. We tell the person what we did and why, unless the law stops us; they can object at support@orquestapp.com, and we reply within 10 business days. Where waiting would put learners or OrQuest at risk, we act first and explain straight afterwards.
Closing an account does not end a paid subscription; it stays with your store account. If we ever end the subscription itself, we refund the unused part (section 10.4). If you deliberately break these rules and cause loss to us or other learners, you are responsible for it under the law.
14. Your account and your information
- Optional, and for adults only. Sign in with Apple (on iPhone and iPad, and on Android if we offer it), with a code sent to your email, or with Google if we offer it. An account saves one adult profile's progress (section 6.3); child profiles are never saved to one.
- What the sign-in screen tells you. Signing in saves your learning progress, including Torah study, to your account, and that can show that you study Jewish texts. Choosing to sign in is your consent to that; deleting your account withdraws it.
- Keep your email, your Apple Account and, if you use it, your Google Account secure: whoever controls them can sign in to your OrQuest account. If someone else may have used it, tell us: we can end the account's sessions on every device (they stop working within an hour) and, if you ask, delete the account, and we take it into account before acting under section 13. We are not responsible for what someone else does in your account with your email, Apple Account or Google Account, unless our own fault made it possible or the law makes us responsible (section 16).
- No advertising email. Apart from replies to you, we email account holders only sign-in codes, the notices these Terms or the Privacy Policy describe, security notices and notices the law requires, and never send advertising by email or text without your express prior consent, as section 30A of Israel's Communications (Telecommunications and Broadcasting) Law, 5742-1982, also requires.
- Signing out stops saving to the account and, on a device where you joined the live league, takes you out of it (if the app cannot reach us at that moment, your league name stays on that week's board until the week ends); signing out on another device leaves your place on the board as it is. We keep an account until you delete it or we stop offering OrQuest, and never close it for being unused.
- Delete account is in Settings under Account (with a child profile on the device: For parents, then Account and subscription, after the parent question), or at Delete your OrQuest account. It deletes the account and what it holds at once, and we tell RevenueCat to delete the purchase record it keeps for the account; backups and logs expire within 7 days, and records we must keep, or that RevenueCat has not yet deleted, stay longer, as the Privacy Policy explains. It does not delete what is on your device or cancel a subscription.
- Delete everything clears the device's profiles, progress and settings, but on purpose keeps the one-time offer's timing, the reminders already set before a free trial ends or a yearly subscription renews (including the one set a year ahead) and the monthly plan's yearly reminder (section 8.8), and, if you were signed in with an active subscription, the device's note that it is still active. It also signs this device out of your account, with the same effect on the live league as signing out. It does not delete an account or cancel a subscription, and it cannot be undone: your device backups do not hold the profiles or progress it deletes, and only the synced adult profile's progress comes back, when you sign in again.
15. What OrQuest is not
These are honest descriptions of what OrQuest is. We take reasonable care with all of it, section 16 applies if we fall short, and nothing here limits section 18.
- Not a halakhic authority. OrQuest describes customs and quotes sources; it does not rule on them or replace a rabbi, a teacher, a class or a congregation. Customs differ between communities: OrQuest may describe one or name several, and settings such as nusach show one tradition at a time. For a question of practice, ask a rabbi or a teacher you trust.
- The texts. We compared the Torah verses letter by letter with a second, independent edition; one passage has not been through that check yet, and its screen says so. The prayers are quoted from the named siddur editions, with cantillation and some marks removed. Errors can still happen: before reading in public or for a ritual, check a printed Chumash or tikkun, or with your teacher.
- Translations and history. Simplified for learners, some written for children, each one reading among several. History is told in short accounts, not scholarship, and OrQuest takes no political position on contested places.
- Voices. The verses of the Torah passages are read aloud by a ready-made AI voice; no one was recorded for OrQuest, and we did not clone anyone's voice. Other speech uses your device's voice. Either voice can mispronounce a word, stress it or pause in the wrong place, or read differently from your tradition: follow the written text on the screen, and for reading in public or for a ritual, learn the reading from a teacher. The four-letter Name is read as Adonai, as in the synagogue. OrQuest does not listen to you or record anything you say.
- The calendar follows the Jewish year as kept in Israel, including Israel's weekly Torah reading, which in some years is one parashah ahead of the reading outside Israel for part of the year. It shows no prayer or candle-lighting times, so check a local listing for those. Outside Israel, also check the weekly reading in your community's calendar, for example before preparing a bar or bat mitzvah reading.
- Places and safety. Place guides and the phrasebook give general information that changes, such as opening hours, prices, dress codes, access, security and the arrangements at holy sites. Follow local law and the instructions of site and security staff, and base safety decisions on official sources, not on OrQuest.
- Not an emergency service. In Israel, call 100 for the police, 101 for an ambulance, 102 for the fire service, or 112 from a mobile phone. Elsewhere, call the local emergency number.
- The leagues. Live groups hold only real people under generated names, never bots: signed-in adults, as far as the age question can tell (section 5.4). The practice league's names and scores are invented. Promotion and relegation apply only in groups of 11 or more, moving up needs XP that week, and only XP from Sunday to Friday (Israel time) counts, on the live league up to 2,000 XP a day.
- Estimates. Plan dates and counts, such as how many verses you may know by a date, are estimates at your chosen pace, not promises.
- Supervision. The parent question is a speed bump, not a lock (section 5.5), and anyone with the device can open the Family screen.
- Media made with AI. The illustrations, films and reward icons were made with AI tools before release (Credits and licences). They illustrate the lessons and may simplify or imagine how people, places and objects looked: learn from the words in the app, not from the details or any lettering in a picture.
- Availability. We do not promise OrQuest will always be available or free of errors. Online features depend on a connection, our providers and the stores, and we may pause them briefly for maintenance or security. Section 16 applies to outages.
- Not professional advice. Nothing in OrQuest is legal, medical, financial, travel-safety or other professional advice.
- Found a mistake? Write to support@orquestapp.com naming the lesson, passage or screen. We read every report and fix the errors we confirm in a later update.
16. Our responsibility to you
16.1 What we promise, and what you get if something goes wrong
We provide OrQuest with reasonable care and skill, as described in these Terms, the app and its store listing. If it has a fault or is not as described, tell us: we fix it within a reasonable time at no cost to you; if we cannot, we extend your subscription for the time lost or, where an extension would not put it right, refund the affected part (section 10.4); and if the fault is serious and lasting, you may cancel and get back the unused part (section 10.4). These remedies add to your rights under the law. This promise lasts while your free trial or subscription is active; to claim, tell us what is wrong through any channel in section 27, and claiming costs you nothing.
16.2 What we are responsible for
If we break these Terms, we are responsible for loss or damage you suffer that we foresaw, or should have foreseen, as a likely result of the breach. If we are negligent or otherwise at fault, we are responsible for any loss or damage the law makes us responsible for. There is no money limit on our responsibility to consumers.
16.3 What we are not responsible for
Unless our own fault caused or contributed to it (and then to that extent), or the law makes us responsible, we are not responsible for:
- problems caused by your device, its operating system or voice, your connection, or Apple's or Google's services;
- what is done by websites, apps and services that we do not control and that do not act for us, such as the pages we link to (including the siddur's sources), the apps you share a card to and the people you send it to, and your email or phone provider;
- loss of progress kept only on your device because the device was lost, damaged, reset or replaced, the app was deleted, Delete everything or Reset lesson progress was used, or the device's storage failed. If our fault causes such a loss, for example a faulty update, we do what we reasonably can to restore it, though we cannot restore what never reached us, and sections 16.1 and 16.2 apply;
- decisions based on information used in a way section 15 warns against, where we took reasonable care over it;
- delay caused by an event outside our reasonable control, such as a widespread outage of a provider's service that we could not reasonably prevent or work around, a power or internet failure, war, or an order of an authority, while it lasts. We limit its effect as far as we reasonably can, and if it stops you using what you paid for, section 16.1 applies.
16.4 What we never exclude or limit
Nothing in these Terms excludes or limits our responsibility for death or bodily injury; fraud or fraudulent misrepresentation; wilful misconduct (זדון) or gross negligence; your rights under consumer-protection and privacy laws; or anything else the law does not allow us to exclude or limit.
17. If you use OrQuest for a business
This section applies only to business users, never to consumers. Our total responsibility to you for all claims connected with OrQuest is limited to the greater of what you paid for OrQuest in the 12 months before the claim arose, or ₪400. We are not responsible to you for loss of profit, revenue, business, contracts or goodwill, or for indirect or consequential loss. You are responsible to us for loss from a third party's claim that results from your breach of these Terms, to the extent the law allows. This section never excludes or limits responsibility for death or bodily injury, fraud, wilful misconduct, gross negligence, or anything the law does not allow to be limited. In Australia, this section also does not apply where it would be an unfair term in a small business contract.
18. Your consumer rights come first
This section applies despite anything else in these Terms, including sections 25 and 26. Nothing in these Terms takes away or limits a right the law gives you as a consumer that a contract cannot exclude, and if anything here seems to, this section wins.
- Israel. Nothing limits your rights under the Consumer Protection Law, 5741-1981, the Standard Contracts Law, 5743-1982, the Legal Capacity and Guardianship Law, 5722-1962, or the Protection of Privacy Law, 5741-1981. Section 24 gives the information Israeli law requires.
- United States. You keep every right federal and state consumer-protection laws give you that a contract cannot waive, including state laws on automatic renewals. California users can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone on 800-952-5210; section 2 gives our details and section 8 our charges.
- Switzerland. You keep the protection of mandatory Swiss law, including its rules against unfair general terms.
- Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. Nothing in these Terms excludes, restricts or modifies those rights.
- New Zealand. If you acquire OrQuest as a consumer, nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
- Everywhere else. You keep every right your local consumer law gives you that a contract cannot exclude.
19. Ending this agreement
- You can stop using OrQuest at any time. To stop paying, cancel (section 9); to remove your information, use Delete account and Delete everything (section 14).
- We may suspend or end your licence or account only for a serious or repeated breach of section 7.1 or 13, after telling you the problem and giving you a reasonable chance to put it right, or where a law, court or authority requires it, or, for an account, when we learn that it belongs to someone under 18 (section 5.4). If the breach cannot be put right, is unlawful, or puts learners or OrQuest at risk, we may act at once and explain straight afterwards. We never act for a minor or technical breach. If you have a paid subscription, we tell you how to cancel it (on Google Play, we cancel it ourselves) and refund the unused part (section 10.4); if a suspension stops you using what you paid for, we extend your subscription by that time or refund it (section 10.4).
- If we stop offering OrQuest, we tell you at least 30 days before, or as soon as events outside our control allow; we stop sales and renewals, refund the unused part of any paid period (section 10.4), and say when accounts and synced progress will be deleted.
- What continues. As far as relevant, sections 3, 4, the restrictions in 7.1, 7.2, 7.3, 9.3, 9.4, 10, the last paragraph of 13, 15 to 19, and 21 to 27 continue after this agreement ends.
20. Changes to these Terms
We change these Terms only to reflect a change under section 12; because of a change in the law, a court's or regulator's decision, or store rules; to add protections or rights for you; to describe new or changed plans, trials or offers before we offer them; to reflect a transfer under section 21 or a change in our details; or to make them clearer or correct a mistake without changing their meaning.
- A change that does not reduce your rights applies from the date we publish it, or a later date we state.
- A change that could reduce your rights comes with at least 30 days' notice (section 2). With a subscription, it applies to you from your first renewal at least 30 days after the notice, and until then you may cancel and get back the unused part (section 10.4). Without one, it applies 30 days after the notice. Where your law sets a window for this notice (New York does), we also give one within it, in the app.
- The stores are told first. Before a significant change to these Terms, we tell Apple and Google, as some laws require.
- If the law or a court requires a change sooner, it applies when required, and we tell you as soon as we can.
- No change is ever backdated. Every version stays at Past versions with its effective date.
21. If OrQuest changes hands
We may transfer this agreement only to someone who takes over OrQuest, and only together with all our obligations to you, with at least 30 days' notice, or as much as a law or events outside our control allow. A transfer does not reduce your rights, and you may cancel before it takes effect and get back the unused part (section 10.4). You may not transfer this agreement.
22. Law, courts and disputes
- Talk to us first, if you wish. We reply in substance within 10 business days and try to put things right. This is optional, and nothing depends on it.
- Governing law. The law of the State of Israel governs these Terms. If you are a consumer living outside Israel, you also keep the protection of the mandatory laws of the country where you live. If you are a consumer living in Switzerland and Swiss law does not allow a consumer contract to choose another law, Swiss law applies instead.
- Courts. You may bring a claim in the competent court in Israel under the law, including the small-claims court. A consumer living outside Israel may also sue in the courts where they live, where their law gives that right. We bring a claim against a consumer only in the courts of the place where they live.
- Your right to go to court. Nothing in these Terms requires arbitration, limits your right to go to court, shortens the time the law gives you to bring a claim, or makes our records conclusive.
23. General
- Invalid parts. If part of these Terms is invalid, the rest stays in force, and that part applies to the extent the law allows.
- Delay. A right is not lost because either of us is slow to enforce it.
- Service providers. We use service providers to help run OrQuest. Using them never reduces what we owe you under these Terms: for what they do for us, section 16 applies as if we had done it ourselves.
- The whole agreement. These Terms, your Purchase summary, and what OrQuest's subscription screen, the store listing and the store's purchase screen told you about OrQuest are the whole agreement between you and us, subject to section 18 and to anything else the law makes part of it. The Privacy Policy is not part of it.
- Others. No one else has rights under these Terms, except Apple and its subsidiaries under section 25.
- Writing includes email. Headings do not change the meaning.
24. Information for consumers in Israel (מידע לצרכנים בישראל)
This part gives the information the Consumer Protection Law, 5741-1981, requires, including for a distance sale (עסקת מכר מרחוק) and a continuing transaction (עסקה מתמשכת). We give it as the provider of OrQuest, whichever store bills you, and where anything elsewhere gives you less, this part applies. A "consumer in Israel" is anyone who lives in Israel, or bought OrQuest in the Israeli App Store or Google Play store, and uses it as a consumer. Your Purchase summary repeats the main points of it for your purchase.

24.2 Who sells and who charges
On the App Store, Apple Distribution International Ltd. sells and charges the subscription, under Apple's terms for Israel. On Google Play, we are the seller and Google Play takes the payment. Either way, we are the dealer for OrQuest: we give you this information and accept and act on your cancellation notices.
24.3 The free trial
Section 8.3 and your Purchase summary set out the trial. If the trial is not cancelled in time, the store charges automatically at the price shown; to be sure you pay nothing, cancel in your store by the last day shown. The trial reminder is an extra service; your rights do not depend on it.
24.4 Cancelling at any time
- In the store, or from OrQuest's Settings (section 9.1).
- At once, with a pro-rata refund, through the store: if your Apple Account is in Israel, ask Apple Support under Apple's terms for Israel, including on 03-3762915 (section 10.1); on Google Play, where Google offers it, choose to cancel immediately and request a partial refund (Google's page).
- By a notice to us: by phone, email or registered mail (section 24.1), or through the Cancel a subscription link on the orquestapp.com home page (ביטול עסקה on the Hebrew home page), which opens Cancel a subscription. It needs only your name and ID number, and no reason.
A notice to us takes effect no later than 3 business days after we receive it, or, if sent by registered mail, 6 business days after the day it was posted, unless you name a later date. You are not charged for any later period, and you get back the unused part of what you paid, with no cancellation fee. On Google Play we end the subscription and refund you ourselves within that time. On the App Store only Apple can stop the billing, so our reply within 1 business day gives you Apple's steps and, if your Apple Account is in Israel, Apple's route to end it at once with a pro-rata refund; if the law entitles you to that refund from us and Apple does not give it, we pay it (section 10.4), and section 24.6 covers a later charge.
24.5 The 14-day right
You may also cancel a new subscription within 14 days of its first paid charge, or of receiving your Purchase summary (the first time you open it, section 8.9) if later, and get back what you paid, less only a proportional amount for the paid days it was active, with no fee. On Google Play we give this right, like the right to cancel a distance sale under section 14C of the Consumer Protection Law, whether or not the law requires it for an app subscription, and we refund when we act on your notice (or the full first charge under section 10.2, if larger). On the App Store, Apple refunds: if your Apple Account is in Israel, Apple's terms for Israel let you cancel at any time with a pro-rata refund (section 10.1), and if the law gives you this right and Apple does not give the refund, we pay it ourselves (section 10.4).
24.6 If Apple charges you after your notice
If your notice gave your name and ID number, and Apple still charges you for OrQuest more than 3 business days after we received it, we pay that charge back ourselves within 14 days of when you tell us of it and show it to us, by a method we agree with you. Any record of the charge will do, such as the Apple receipt, its order ID or the line on your card statement.
24.7 Minors, the one-time offer, and refunds
- Minors. Only an adult may buy. A parent or guardian may cancel a minor's purchase made without their consent (section 10.3), and nothing here limits that right.
- The one-time offer is a special sale. Section 8.4 gives what it includes, the price before the discount, the discount and what it is measured against, the discounted price, when it ends, who may take it, and that there is no limit on how many people can take it.
- Refunds. What these Terms say about refunds does not apply where the law gives you a right to cancel or to a refund, and does not reduce that right.
These Terms, the Purchase summary and the cancellation page are all in Hebrew: תנאי השימוש and ביטול עסקה.
25. If you got OrQuest from the App Store
If you got OrQuest from the App Store, you and we also agree to these terms, which Apple requires.
- 1. Parties. These Terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for OrQuest and its content. These Terms set no usage rules for OrQuest that conflict with the Apple Media Services Terms and Conditions.
- 2. Scope of licence. Your licence to use OrQuest is limited to a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that OrQuest may be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts. (This concerns the app itself; the OrQuest subscription is not shared through Family Sharing: section 8.2.)
- 3. Maintenance and support. We are solely responsible for providing maintenance and support for OrQuest, as these Terms set out or as the law requires. Apple has no obligation whatsoever to furnish any maintenance and support services for OrQuest.
- 4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
- If OrQuest fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for OrQuest to you.
- To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to OrQuest.
- Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility, under sections 16 and 18.
- 5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to OrQuest or your possession and use of it, and these Terms do not limit our liability to you beyond what the law permits. Those claims include:
- product liability claims;
- any claim that OrQuest fails to conform to any applicable legal or regulatory requirement;
- claims arising under consumer protection, privacy or similar legislation, including in connection with an app's use of the HealthKit and HomeKit frameworks (OrQuest uses neither).
- 6. Intellectual property. If a third party claims that OrQuest, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- 7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- 8. Developer contact. Questions, complaints and claims about OrQuest go to Yaniv Cohen, trading as OrQuest, 12 HaShoftim St, Tel Aviv, Israel; phone +972 52 386 4584; email support@orquestapp.com.
- 9. Third-party terms. You must comply with any applicable third-party terms when using OrQuest, such as the terms of your mobile data service.
- 10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
For App Store users, if this section conflicts with the rest of these Terms, this section applies. Section 18, your consumer rights, always applies.
26. If you got OrQuest from Google Play
The Google Play Terms of Service govern your use of Google Play and your payment through it. Google is not responsible for OrQuest or these Terms; we are. Our Google Play refunds are in section 10.2, and section 18 always applies.
